Section 86(8): Penalty for Breach of Voluntary DVAT Registration Conditions
Section 86(8) of the Delhi Value Added Tax Act, 2004 provides a fixed penalty where a person who obtained voluntary registration fails to commence the stated dealer activities within the promised period or breaches conditions attached to registration.
A fixed statutory amount, not a daily penalty.
What does Section 86(8) provide?
The provision applies when a person has applied for voluntary registration under Section 18(4) and has actually been registered, but subsequently meets either of these default conditions:
- The person does not undertake activities that would make them a dealer within the period stated in their registration application; or
- The person fails to comply with restrictions or conditions subject to which voluntary registration was granted.
For either statutory default, Section 86(8) specifies a penalty of Rs. 10,000. It does not describe a recurring per-day amount or a separate higher maximum.
Relevant legal provisions explained
Section 18(4) - Voluntary registration
Section 18(4) permits an eligible person who is not otherwise required to register to seek voluntary registration, subject to the applicable statutory requirements. Registration can carry restrictions and conditions, and an applicant's declared timeframe for beginning dealer activities becomes relevant to Section 86(8).
Section 86(8) - Penalty for non-compliance
This penalty is specifically tied to a person who applied under Section 18(4), obtained registration and then failed to meet the activity-commencement undertaking or registration conditions. It should not be confused with penalties for late compulsory registration, false claims of registration or delayed return filing under other subsections of Section 86.
Penalty at a glance
| Governing law | Delhi Value Added Tax Act, 2004 |
|---|---|
| Penalty provision | Section 86(8) |
| Related registration provision | Section 18(4) |
| Nature of default | Failure to begin qualifying dealer activities within the stated period, or breach of voluntary registration restrictions or conditions |
| Penalty amount | Rs. 10,000 |
| Daily accumulation | Not prescribed under this subsection |
Practical example
A person obtains voluntary DVAT registration after stating in the application that dealer activities will begin within a specified period. If the person fails to begin those activities by that period, the circumstances may attract the Rs. 10,000 penalty under Section 86(8). The same provision can apply where an applicable condition of voluntary registration is breached.
Does Section 86(8) still matter after GST?
The Goods and Services Tax framework commenced on 1 July 2017 for most goods and services. However, Delhi VAT continues to be administered for goods and transactions that remain within its scope, and historical DVAT registration and penalty matters may still require consideration under the law applicable to the relevant period. The applicability of Section 86(8) in a particular case depends on the registration, transaction, relevant dates, statutory amendments and any applicable transitional provisions.
Businesses seeking new GST registration should refer to the current GST law rather than treating voluntary DVAT registration as the general registration route.
