Ministry of Education Coaching Centre Guidelines, 2024
The Ministry of Education issued Guidelines for Regulation of Coaching Center, 2024 for consideration and implementation through appropriate legal frameworks by States and Union Territories. They address registration, fees, infrastructure, student welfare, counselling, grievance redressal and safety. The guidelines should not be mistaken for a uniform central licensing law independently enforceable in identical form in every state.
Operators should check the applicable state legislation and rules, including any minimum-age, space, fire-safety, faculty-qualification, refund-policy and student-welfare provisions. The Ministry's August 2026 parliamentary response confirms the state-focused regulatory approach.
Consumer Protection Act, 2019 and Coaching Advertisements
Section 2(28) of the Consumer Protection Act, 2019 defines a misleading advertisement, including representations that falsely describe services or conceal important information. Section 18 sets out the Central Consumer Protection Authority's powers and functions relating to consumer rights, unfair trade practices and misleading advertising.
The Guidelines for Prevention of Misleading Advertisement in Coaching Sector, 2024 apply to coaching-sector advertisements. Institutes should avoid unsupported success claims, guaranteed selection promises and misleading use of student results. Material course information and applicable disclosures must be clear and accurate.
Other Potentially Applicable Requirements
- Business structure: choose a proprietorship, partnership, LLP, company or other lawful form and complete the registrations applicable to that form.
- Local establishment rules: check state Shops and Establishments provisions, trade permissions and municipal land-use restrictions where applicable.
- Fire and building safety: obtain required clearances and comply with occupancy, exits and emergency arrangements under local law.
- GST: assess registration and taxability under the Central Goods and Services Tax Act, 2017 and applicable state GST law. Private commercial coaching is not automatically exempt merely because it is educational.
- Employment and data: follow applicable labour, employee-benefit and personal-data obligations, particularly where student records or minors' data are collected.
How to Plan a Coaching Centre Launch
- Choose subjects, target learners, course duration and delivery mode.
- Estimate student demand, pricing, expected enrolment and break-even capacity.
- Shortlist premises and verify local registration, building and safety conditions before signing a lease.
