Startup Cost of a Tax Consultant Profession in India
A tax consultancy can provide tax compliance support, return preparation, bookkeeping and related advisory services, subject to the qualifications and authorisations required for particular activities. This guide explains office requirements, indicative investment and key Indian legal provisions.
Office space and essential facilities
A small tax consultancy may operate from an office of approximately 150 square feet or more, depending on staffing, client visits and local building rules. Typical setup expenses include rent or security deposit, a computer, secure internet access, licensed software, printer or scanner, furniture and data protection arrangements. Remote or shared-office models may need less space.

Legal requirements for starting a tax consultancy
Business structure and registration
A proprietor may operate in their own name or under a trade name, subject to applicable local registrations. A partnership, LLP or company involves additional formation and ongoing compliance. LLPs are governed by the Limited Liability Partnership Act, 2008; companies are governed by the Companies Act, 2013. Registration and filings are available through the Ministry of Corporate Affairs. State shops and establishments requirements, municipal permissions and professional tax rules may also apply depending on location.
Income-tax representation: Section 288
Section 288 of the Income-tax Act, 1961 addresses appearance by an authorised representative in proceedings to which that provision applies and specifies eligible categories and restrictions. Preparing a return is not the same as being entitled to represent a taxpayer in every proceeding. Practitioners should check the applicable law, commencement and transitional provisions for the relevant tax year, including the Income-tax Act, 2025 where operative. Refer to the Income Tax Department and India Code for current legislation.
GST practitioner registration: Section 48
Section 48 of the Central Goods and Services Tax Act, 2017 provides for goods and services tax practitioners. Rules 83 and 84 of the CGST Rules, 2017 deal with enrolment and related procedures. A person offering services as a registered GST practitioner must satisfy the prescribed eligibility and procedural requirements. Taxpayers remain responsible for their statutory obligations. See the GST portal and CBIC GST resources.
GST registration for the consultancy
Sections 22 and 24 of the CGST Act, 2017 set out registration liability and specified compulsory-registration situations, subject to amendments and notifications. The ordinary service-supplier threshold is generally Rs. 20 lakh in aggregate annual turnover, with a lower threshold in specified states; exceptions and special rules must be checked. GST practitioner enrolment and GST registration of the consultancy are distinct matters.
Professional qualifications and restricted services
Tax return preparation or general tax consultancy does not automatically confer the right to perform statutory audits, issue professional certificates reserved for qualified persons, or practise law. Section 44AB of the Income-tax Act, 1961 concerns tax audit requirements for applicable periods; audit reports must be signed by an eligible accountant as defined in the relevant legislation. Chartered accountancy practice is regulated under the Chartered Accountants Act, 1949, and legal practice is governed by the Advocates Act, 1961. Consult ICAI and the relevant professional regulator.
Client confidentiality and personal data
Tax consultants routinely handle PAN, financial statements and other confidential information. Use access controls, secure document storage, limited retention, confidentiality agreements and reliable backups. Review the Digital Personal Data Protection Act, 2023 and applicable rules, commencement notifications and transitional arrangements before determining specific duties. Official legal texts can be checked at MeitY and India Code.

Frequently asked questions
Is a 150-square-foot office compulsory?
No. It is a practical example from the original cost estimate, not a universal legal minimum. Premises requirements depend on the business model and local rules.
Can anyone call themselves a tax consultant?
The general description does not itself grant statutory representation, audit or certification rights. Specific regulated services require the qualifications and permissions prescribed by law.
Are the estimated costs official government rates?
No. They are illustrative business-planning ranges, not government fees or current quotations.
