Section 10(26BB) Income Tax Exemption for Minority Community Development Corporations

Section 10(26BB) of the Income-tax Act, 1961 provides an income-tax exemption for a qualifying corporation established by the Central Government or a State Government to promote the interests of members of a minority community notified by the Central Government.

Key point: This is an entity-level exemption for an eligible corporation. It does not exempt the income of every government undertaking or the personal income of individual members of a minority community.

Meaning of Section 10(26BB)

Under Section 10(26BB), any income of a corporation established by the Central Government or any State Government for promoting the interests of members of a minority community notified by the Central Government is excluded from total income, provided the statutory conditions are met. The provision should be read with the applicable notification identifying minority communities.

Eligible assessee, income and exemption

Eligible assesseeA corporation established by the Central Government or a State Government for the prescribed minority-community welfare purpose.
Required purposePromotion of the interests of members of a minority community notified by the Central Government.
Nature of incomeAny income of a corporation satisfying Section 10(26BB).
Amount exemptThe entire qualifying income of the eligible corporation, subject to the statutory conditions.
Exemption applies toThe qualifying corporation itself, not automatically to its employees, borrowers, beneficiaries or members of a community.

Conditions for claiming the exemption

  1. Government establishment: The entity must be a corporation established by the Central Government or a State Government. Mere government shareholding or financial assistance does not by itself prove compliance.
  2. Qualifying objective: Its establishment must be for promoting the interests of members of the notified minority community.
  3. Notified minority community: The community must fall within the relevant Central Government notification. Check the notification and its legal context for the applicable period.
  4. Supporting records: Keep the incorporation or establishment instrument, government orders, governing objects, applicable notifications and audited accounts to substantiate the claim.

What is a notified minority community?

For this provision, the relevant minority community is one notified by the Central Government. The Ministry of Minority Affairs provides information about the centrally notified minority communities and government minority-welfare programmes. A general description of a community as a minority is not, by itself, a substitute for verifying the applicable notification.

Examples of activities undertaken by eligible corporations

Depending on their statutory objects, government-established minority development corporations may support education, skills, entrepreneurship, employment, concessional financing and other welfare initiatives. Such activities help explain the public purpose of these corporations, but activities alone do not confer exemption; the legal requirements of Section 10(26BB) control eligibility.

Section 10(26B) versus Section 10(26BB)

Section 10(26B) addresses certain corporations and wholly government-financed bodies concerned with the interests of Scheduled Castes, Scheduled Tribes, backward classes and other groups specified in that provision. Section 10(26BB) specifically concerns corporations established by the Central or State Government to promote the interests of members of a centrally notified minority community. Each provision has distinct eligibility conditions and should be applied separately.

Tax treatment of individuals and other entities

A qualifying corporation's exempt income should not be confused with the taxation of salaries, grants, loans, interest receipts or other income in the hands of individuals and third parties. The tax treatment of such receipts depends on their own applicable provisions. Similarly, a private organisation serving minority communities does not automatically become eligible under Section 10(26BB).

Applicable law from 1 April 2026

The Income-tax Act, 2025 came into effect on 1 April 2026. Section 10(26BB) is the numbering used under the Income-tax Act, 1961, relevant to periods governed by that Act. For later tax years, verify the corresponding provision and any applicable transitional rules under the Income-tax Act, 2025 before claiming an exemption.
