Income Tax Appeal Services

First Appeal: JCIT(A) or CIT(A)
Under the Income-tax Act, 2025, sections 356 to 360 contain the principal framework for first appeals before the Joint Commissioner (Appeals) and Commissioner (Appeals). The correct appellate authority depends on the type of order and allocation of jurisdiction. The appellate hierarchy remains broadly the same as under the earlier law.
For cases governed by the Income-tax Act, 1961, the corresponding first-appeal provisions continue to apply under the savings rules. Appeals against eligible Assessing Officer orders are ordinarily filed electronically using the prescribed form through the Income Tax e-Filing Portal.
Appeals Before the Income Tax Appellate Tribunal
Sections 361 to 364 of the Income-tax Act, 2025 contain the principal provisions relating to appeals to the Appellate Tribunal, procedure and Tribunal orders. ITAT is a specialised quasi-judicial institution dealing with appeals under direct tax laws. Its findings may be challenged before the High Court where the statutory requirements for a further appeal, including a substantial question of law, are satisfied.
ITAT operates an official electronic filing system. Current filing requirements, checklists and practice notes should be verified through the ITAT e-Filing Portal and ITAT e-Filing Help. Current procedure should be followed instead of relying on superseded physical-filing practices.
Appeals to High Court and Supreme Court
Sections 365 to 368 of the Income-tax Act, 2025 address further appeals to the High Court and Supreme Court. A High Court appeal is not simply another factual appeal: the statutory conditions governing a substantial question of law are central to maintainability. Further proceedings before the Supreme Court are governed by the applicable income-tax provisions together with constitutional, statutory and Supreme Court procedural requirements.
How an Income Tax Appeal Is Prepared
Effective appellate preparation generally begins with the complete record: the impugned order, return and computation, notices, replies, evidence, assessment records available to the taxpayer, earlier appellate material and relevant judicial authorities. The grounds should identify the specific legal or factual errors without unnecessary narrative.
Depending on the forum and case, work may include a statement of facts, grounds of appeal, delay-condonation application, stay application, written submissions, paper book, additional evidence application, additional grounds, cross-objections and compilation of judicial precedents. Requirements differ by forum and by the law governing the relevant tax year.
Limitation and Transition Between the 1961 and 2025 Acts
Limitation is a critical part of appellate work. The Income Tax Department states that the appellate hierarchy and limitation framework remain materially unchanged under the Income-tax Act, 2025. Nevertheless, the applicable deadline must be calculated from the particular statutory provision and the legally relevant date of service or communication.
Section 536 of the 2025 Act is especially important during transition. An appeal pending on April 1, 2026 continues under the Income-tax Act, 1961. Likewise, proceedings initiated on or after April 1, 2026 for a tax year beginning before that date are generally governed by the repealed Act. A limitation period that had already expired before commencement of the new Act is not automatically revived.

Who may represent a taxpayer depends on the forum and applicable law. Representation before income-tax authorities and ITAT must comply with the statutory provisions governing authorised representatives and the procedural rules of the forum.
